Welcome to MonMe.com! 
MonMe.com (the "Service") is owned and operated by FunPeas Media Ventures, LLC (also referred to herein as "MonMe", "We", "Us", "Our"). By pressing the "SUBMIT" button at the Sign-up Page, you agree to the following terms of use, which constitute an agreement  between MonMe and you.  We may change these terms from time to time. You will always be able to view the most current version by clicking on a link at the bottom of any page on our site.

Description of Service
MonMe.com is a website monitoring service provided to its members ("Member") for monitoring the members' websites. 

Member Criteria
1. There is no fee to establish a MonMe member account
2. By completing the Sign-Up Form, you agree to provide true, accurate, current and complete information(including an accurate email address) as prompted by the Sign-up form.  
3. You are a member as soon as you have activated your account by entering the activation code sent to you via email from MonMe after you submit the sign-up form.
4. You provide link(s) on your web site to refer MonMe.com with your web site visitors.

Website Criteria
1. The web site that you are asking MonMe.com to monitor must be your web site or web sit that you are in charge of.  Do not monitor other organization/individual's web sites without permission from the owners.  
2. You acknowledge that MonMe does not pre-screen, verify, approve, review or endorse the content of your website before accepting it to be monitored by our Service. We shall not be held responsible for any sites, pages, links or advertisements in any form monitored by our Service.  However, We shall have the right in our own discretion to refuse or remove any website from our Service that we deem is inappropriate to our Service.  

Service Rules
1. Members may cancel membership at any time by writing to account(at)MonMe(dot)com.

Member Responsibility
1. Keep all account information with us up-to-date and accurate.
2. Maintaining the confidentiality of the password and account, and are fully responsible for all activities that occur under your password or account.
3. You are solely responsible for the content of your website, and all content that you post, email, transmit or otherwise make available via the Service. 

Our Responsibility
1. We will monitor your web page as described in the Service.  

Termination of Member Account
The following member account is subject to termination.

1. Website violate this terms of service.
2. Member is found to conduct spamming activities (see Anti-Spam Policy). 
3. Account not activated within 5 days after sign-up.
4. Account inactive for more than 14 days.

Indemnity
You agree to indemnify and hold MonMe, and its subsidiaries, affiliates, officers, agents, co-branders or other partners, and employees, harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of content you submit, post, transmit or make available through the Service, your use of the Service, your connection to the Service, your violation of this agreement, or your violation of any rights of another.

MonMe does not control the content of the websites monitored in the Service and, as such, does not guarantee the accuracy, integrity or quality of such content. You understand that by using the Service, you may be exposed to content that is offensive, indecent or objectionable. Under no circumstances will MonMe be liable in any way for any content of the websites monitored by the Service.

Disclaimer OF Warranties
You acknowledge and agree that your use of the Service is at your sole risk.  The Service is provided on an "as is" and "as available" basis.  MonMe expressly disclaims all warranties of any kind.  We make no warranty that the Service will be uninterrupted, timely, secure, or error-free.

Limitation of Liability
In no event shall we be liable for any direct, indirect, special consequential or incidental damages whatsoever (including, without limitation, damages for loss of profits, business interruption, loss of information of data) arising out of the use or inability to use the Service, even if we have been advised of the possibility of such damges. 

General
This Agreement is governed by the laws of the State of New York (USA), without reference to rules governing choice of laws.  The parties agree to submit to the New York Courts only, any dispute arising out of this Agreement or related thereto and consent to the jurisdiction of said courts and further agree that any and all matters of dispute shall be adjudicated, governed and controlled under and by New York law and this paragraph shall supersede any conflicting choice of law rules.  You may not assign this Agreement, by operation of law or otherwise, without our prior written consent.  Subject to that restriction, this Agreement will be binding on , inure to the benefit of and be enforceable against the parties and their respective successors and assigns.  Our failure to enforce your strict performance of any provision of this Agreement will not constitute a waiver of our right to subsequently enforce such provision or any other provision of this Agreement.
